SMS Terms and Conditions

These SMS Terms & Conditions (“SMS Terms”) govern the text messaging program offered by TBC Beauty Holdings Inc., (“We,”, "TBC," “us,” or “our”).
By opting in to receive SMS or MMS text messages from TBC Beauty Holdings, you agree to these SMS Terms.
1. Program Description
By enrolling in the TBC text messaging program, you may receive recurring SMS and/or MMS messages from us regarding our products and services, including promotional offers, product launches, restock notifications, discounts, special offers, shopping reminders, cart reminders, order-related communications, and other marketing or transactional messages.
Messages may be sent using an automatic telephone dialing system or other automated technology.
2. Consent to Receive Text Messages
By providing your mobile telephone number and affirmatively opting in to our SMS program, you consent to receive recurring marketing and promotional text messages from or on behalf of TBC at the mobile number you provided.
Consent to receive marketing text messages is not a condition of purchasing any goods or services from TBC.
You represent that you are the subscriber or customary user of the mobile number provided and that you are authorized to consent to receive text messages at that number.
3. Message Frequency
Message frequency varies. The number and frequency of messages you receive may depend on your interactions with TBC, purchases, promotions, and other factors.
4. Message and Data Rates
Message and data rates may apply. Your wireless carrier's standard messaging, data, and other charges may apply to messages you send or receive in connection with the Tones By Cocoa SMS program.
TBC is not responsible for charges imposed by your wireless carrier.
5. How to Opt Out
You may opt out of marketing text messages at any time by replying STOP to a TBC text message.
You may also communicate your request to stop receiving text messages through another reasonable method that clearly communicates your desire to revoke consent.
After you opt out, we may send you a one-time text message confirming that your opt-out request has been received. After your request has been processed, you will no longer receive marketing text messages covered by your opt-out unless you subsequently provide consent to receive them again.
FCC rules recognize reasonable methods of revoking consent and permit a one-time, non-promotional confirmation text following an opt-out request.

7. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to enroll in the TBC SMS marketing program.
By opting in, you represent that you meet this requirement and have the authority to agree to these SMS Terms.
8. Mobile Number Changes
If you change, deactivate, surrender, or transfer your mobile telephone number, you should opt out of the TBC SMS program before doing so.
You agree not to knowingly provide a mobile number belonging to another person without authorization.
9. Supported Carriers and Delivery
Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless carrier and network provider and is outside our control.
We do not guarantee that SMS or MMS services will be available at all times or through every wireless carrier or device.
10. Privacy
Information collected through the TBC SMS program will be handled in accordance with our Privacy Policy.
Your participation in the SMS program does not authorize us to use your mobile number for purposes beyond those permitted by your consent, these SMS Terms, our Privacy Policy, and applicable law.
11. Changes to the SMS Program or These Terms
We may modify or discontinue the TBC SMS program or update these SMS Terms from time to time, subject to applicable law.
Any updated SMS Terms will become effective when posted on our website or on the effective date otherwise stated in the updated terms. Changes will not eliminate any rights you have to revoke consent or opt out of receiving marketing messages.
